Company Ordered to Pay Workers: Fined $70,000 for Failing to Comply
BRAMPTON, ON - Failure to comply with orders to pay amounting to $43,346 relating to seven former employees has resulted in a fine of $70,000 for a Brampton business.
Operating as NE Group of Companies, 1533633 Ontario Inc., the company is in the business of providing merchant terminals used for payments by customers.
The company failed to comply with orders issued by a Ministry of Labour employment standards officer requiring payment of wages to seven employees. The orders were issued in June and July of 2015. Failure to comply with an order issued by an employment standards officer is an offence under the Employment Standards Act.
The wages owed vary from about $3,000 to over $10,000 for each employee. None of the amounts have been paid.
Following a trial, Justice of the Peace Richard Quon convicted the company on seven counts and imposed the fine in Brampton court on October 11, 2016.
In addition to the fine the court imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
A person who contravenes the ESA or its regulations, or fails to comply with an order under the act, is guilty of an offence. An individual convicted under the ESA may be fined up to $50,000 or imprisonment of up to 12 months, or both. A corporation can be fined up to $100,000 for a first conviction, $250,000 for a second conviction, and $500,000 for a third or more convictions.
